The Venice Original E-commerce platform promotes the work and products of Venetian artisans, selected according to the guidelines defined by the Scientific Committee to guarantee quality. The artisan producers sell directly to the end customer, issuing their own invoice. Venice Original E-commerce, managed by the company Veneziana E-commerce s.r.l., with registered office in via della Pila 3/b in Marghera (VE), VAT number: 0461250271, pec: venezianaecommercesrl@legalmail.it, also guarantees the relationship with the carrier for the delivery of the product and the assistance service.

The data provided to Veneziana E- commerce s.r..l through the website at www.veniceoriginal.it (hereinafter the \"Site\"), are processed in accordance with the legislation on the protection of personal data (GDPR Regulation EU 2016/679. Venice Original informs users of the following:

 

1. Owner of the treatment

1.1. The owner of the treatment of personal data is Veneziana E-commerce srl, with registered office in via della Pila 3/b in Marghera (VE), P.Iva: 0461250271, pec: venezianaecommercesrl@legalmail.it

 

2. Nature of processed data and purpose of processing

2.1. The personal data processed are exclusively of users who are legal adults; personal data means any information about a natural person identified or identifiable, directly or indirectly by reference to any other information.

The data processed are the data provided by the user to the Data Controller when registering for the Newsletter Service and/or requesting supplies and/or when sending communications to Venice Original by e-mail or through a specific form, such as name and surname, date of birth, e-mail address, postal address, telephone number, as well as the data collected by Venice Original when navigating on the Site, such as the IP address, information obtained through cookies.

 

2.2 The data will be used for the following purposes:

A) for the performance of the Services requested, for the fulfillment of obligations required by law, regulations or EU legislation, as well as for the exercise of rights in court;

B) with express acceptance, the promotion by e-mail or telephone calls of business proposals relating to and/or connected with the Services of Venice Original E-commerce, and for sending advertising material exclusively concerning the products or services of Venice Original E-commerce, and for conducting market surveys and sending free samples or promotional gifts of modest value;

C) for the analysis of consumer habits and consumption choices, for the creation of a user profile on the basis of the information and preferences expressed during navigation on the Site or during the use of the requested Services, in order to send personalized advertising communications via e-mail, sms, mms, paper mail and telephone calls with operator.

The activity of profiling as identified in section 2.2C will not produce legal effects on the user nor will it affect him/her personally, except for the communication and promotion of personalized offers.

 

3. Compulsory/optional nature of data conferment

3.1 The provision of the data requested at the time of activation of the Services for the purposes identified in section 2.2A above is mandatory, as it is strictly functional to the provision of the Services requested and to comply with legal obligations. Refusal to provide data will make it impossible for Venice Original E-commerce to complete the process of providing the Services requested and/or fulfill its legal obligations.

3.2 The provision of the requested data for the purposes identified in the previous sections 2.2B, 2.2C is optional.

The refusal of consent for the purposes identified in sections 2.2B, 2.2C will have no effect on the provision of Services. Users will still be able to use the services of Venice Original E-commerce.

Users may object to the processing for the purposes identified in sections 2.2B, 2.2C either immediately, by not giving their consent during the activation of the Newsletter Service or other Services, or at a later time, by sending an e-mail to info@veniceoriginal.it. Users tick the checkboxes when activating the Services to consent to the use of the data identified above for the purposes specified therein; if users do not tick a particular checkbox, they will be deemed not to have consented to the processing for such purposes.

 

4. Processing modalities

4.1 Users' data will be collected online during the activation of the requested Services, through comparison of elements of parts of information, or through the use of the e-mail service.

4.2 The data of the Users will be treated through operations of registration, consultation, communication, storage and deletion conducted primarily by electronic means and manually, ensuring that appropriate measures are taken to protect the security and ensure the confidentiality of data processed.

4.3 Users' data, stored in electronic / magnetic / digital form, are stored and archived on a dedicated server; personal data stored in paper form will be stored in special registers and / or archives whose preservation must be guaranteed by placing them in special containers, kept in suitable location. Venice Original E-commerce declares that the data recorded on its servers and/or in suitable locations are protected against the risk of intrusion and unauthorised access, and that it has adopted adequate security measures to guarantee the integrity and availability of the data and to protect areas and places of storage and accessibility.

In particular, the company hosting our server has been duly certified under the Privacy Shield.

4.4 Personal data will be processed by employees and / or collaborators of Venice Original E-commerce acting as managers or processors, within their respective functions and according to the instructions given by Venice Original E-commerce.

 

5. Data Communication

5.1 The personal data of Users may be communicated to persons assigned by Venice Original E-commerce to provide the Services requested and to comply with legal obligations.

The data may be communicated to:

(a) persons, companies or professionals who provide Venice Original E-commerce with assistance, advice and collaboration in accounting, administrative, legal, tax and financial matters;

b) persons delegated and/or entrusted by Venice Original E-commerce to carry out activities or parts of activities related to the provision of the requested Services and all other external subjects who collaborate with Venice Original E-commerce and must be informed of the data in order to correctly fulfil Venice Original E-commerce's obligations under the contract for the provision of services;

c) Public Bodies in the performance of their institutional functions, within the limits provided by laws and regulations.

User data will not be disseminated.

The Owner has appointed Data Processors for the processing of personal data. The updated list of all the Data Processors can be requested from the following e-mail address info@veniceoriginal.it.  Venice Original E-commerce may occasionally update the list.

 

6. Users' rights

6.1 Users (hereinafter \"interested party\") have the right at any time to obtain confirmation of the presence of their personal data and the purposes for which the data are processed. Users also have the right to request updating, correction, deletion or blocking of data and to refuse its use, in whole or in part.

6.2 Users' rights are listed below. Specifically:

6.2.1 The data subject has the right to obtain confirmation as to whether or not personal data concerning him or her is being processed and, if so, access to the personal data and the following information.

6.2.2 The data subject has the right to be informed about:

(a) the identity and contact details of the controller and, where applicable, the controller's representative;

(b) the contact details of the Data Protection Officer, where applicable;

(c) the categories of personal data, their source, the purposes of the processing for which the personal data are intended, and the legal basis of the processing;

(d) any legitimate interests pursued by the data controller or third parties;

(e) the recipients or categories of recipients of the personal data, if any;

(f) where applicable, the fact that the controller intends to transfer personal data to a third country or international organization and the existence or absence of an adequacy decision by the Commission, or reference to the appropriate or suitable safeguards and means by which a copy may be obtained or where it has been made available.

6.2.3 In addition to the above information, the data controller shall provide the data subject with the following additional information:

(a) the storage period of the personal data or, if this is not possible, the criteria used to determine this period;

(b) the existence of the right to request from the data controller access to, rectification or erasure of personal data or restriction of processing concerning him or her or to refuse processing, as well as the right to data portability;

c) where the processing is based on the consent of users, the existence of the right to withdraw consent at any time, without prejudice to the lawfulness of the processing based on the consent given before the withdrawal;

d) the right to lodge a complaint with a supervisory authority (Guarantor for the protection of personal data);

e) whether the disclosure of personal data is a legal or contractual requirement, or a requirement necessary for the conclusion of a contract, as well as whether the data subject is obliged to provide personal data and the possible consequences of not providing such data;

(f) the existence of an automated decision-making process, including profiling, and, in cases where the latter automated decision-making process produces legal effects concerning him or her or similarly significantly affects him or her, relevant information on the logic involved, as well as the importance and consequences of such processing for the data subject.

6.2.4 The data subject has the right to object at any time to the processing of personal data concerning him/her:

(a) on grounds relating to his or her particular situation, including profiling;

(b) where the personal data is processed for direct marketing purposes, including profiling insofar as it is related to such direct marketing.

6.2.5 The data subject has the right to:

(a) obtain from the data controller the rectification of inaccurate personal data concerning him/her without undue delay. Considering the purposes of the processing, the data subject has the right to obtain the integration of incomplete personal data, also by providing a supplementary declaration;

b) receive the personal data concerning him/her that he/she has provided to Venice Original E-commerce, in an electronic format for common use and in an easily readable form, and has the right to transmit such data to another data controller without interference;

(c) obtain from the data controller the erasure of personal data concerning him/her, and the data controller is obliged to erase the personal data without undue delay if any of the following reasons exist:

- the personal data are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

- the data subject withdraws the consent on which the processing is based and where there is no other legal basis for the processing;

- the data subject objects to the processing and there is no overriding legitimate reason for the processing;

- the personal data have been processed unlawfully;

- the personal data must be erased in order to comply with a legal obligation under European Union law or the law of the Member State to which the controller is subject;

d) obtain from the data controller the restriction of processing.

6.3 In order to exercise the above rights and receive information on the entities to which the data is communicated, or on the entities that may become aware of the data in their capacity as data processors or persons in charge of the processing, users may contact Venice Original E-commerce by sending a request using the contact details provided above.

The data controller shall provide information regarding the action taken at the request of the data subject without undue delay and no later than one month after receipt of the request. This period may be extended by an additional two months if necessary, taking into account the complexity and number of requests. The data controller shall inform the data subject of any extension within one month of receipt of the request, together with the reasons for the delay. Where the data subject submits the request in electronic format, the information shall be provided in electronic format where possible, unless otherwise requested by the data subject.

 

7. Duration of treatment

7.1 Personal data will be processed with regard to the purposes set out in section 2.2.A for no longer than is necessary for the performance of the Services requested, and for the time necessary for the fulfilment of the civil, fiscal and tax obligations in force and in any case for a period not exceeding 10 years from the cessation of the obligation underlined (according to the applicable provisions of the statute of limitations).

7.2 Personal data will be processed with regard to the purposes referred to in section 2.2.B (marketing / promotional activities) for no more than 24 months from the date on which consent to the processing of personal data was given.

7.3 Personal data will be processed with regard to the purposes referred to in section 2.2.C (profiling activities) for no longer than 12 months from the date on which consent to the processing of personal data was given.

7.4 At the end of the data processing period, the data will be deleted or permanently anonymized.

 

8. Legal basis of processing

8.1 The legal basis of the processing is in accordance with the consent of the user, the fulfillment of a contractual requirement and the provisions of the law.

 

9. Updating the Privacy Policy

9.1 This Privacy Policy is subject to occasional revision. Venice Original E-commerce will notify users when changes are made to the data processing conditions by posting the changes on the website. If required by applicable law, users will have the opportunity to consent to any new data processing. In case of refusal by the user, his data will not be processed according to the changes in the new privacy policy.

 

10. Transfer to non-EU countries

10.1 Personal data may be transferred to other countries, in case some data controllers hold their server infrastructure there.

10.2 The European Commission has made an \"adequacy decision\" with respect to US data protection laws.

Transfers to the U.S. will be protected by appropriate safeguards, namely the Privacy Shield (more information at https://www.privacyshield.gov/European-Businesses) or the use of standard data protection clauses adopted or approved by the European Commission, a copy of which can be obtained from www.garanteprivacy.it or www.garanteprivacy.it/web/guest/home/footer/contatti.
